How to tell us about infringing content on Birby, and what we do about it.
No agent is registered yet. DMCA safe harbour requires a designated agent registered with the U.S. Copyright Office, which is a separate filing that has not been made. Until it is, this page describes a process but does not confer the protection that process is for.
Reporting infringement
If you believe something on Birby infringes your copyright, send a notice to dmca@birby.live including:
- Identification of the work you say is infringed.
- Identification of the material on Birby, with a link.
- Your contact details.
- A statement that you believe in good faith the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them.
- Your signature, physical or electronic.
Counter-notice
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address.
Repeat infringers
We terminate the accounts of repeat infringers in appropriate circumstances, under the enforcement policy.
Live video
Flagged for counsel. This is live user-generated video, which is a real copyright surface: music playing in the background, third-party content held up to a camera, a shared screen. Takedown of a live broadcast is not the same problem as takedown of a file, and recordings and replays persist after the fact.
Designated agent
Not yet designated. The Nifty Company, and no registered address exists. Both are required on this page and with the Copyright Office.
