Terms of service
The agreement between you and Birby.
1. Acceptance and eligibility
By using Birby you agree to these terms. You must be 18 or older to register an account and to take any action on the platform. Watching is open to anyone.
2. What the service is
Birby is a curated live-video network. Anyone may watch public shows. Chatting and appearing on screen require a registered, verified account. Hosting requires an approved program and a hosting fee. See who can do what.
3. Accounts and verification
You may register with an email address, and you verify your identity by linking a social account or confirming a phone number. You are responsible for the accuracy of what you tell us and for the security of your account.
4. Roles
Anonymous viewers may watch and read chat. Registered users may chat, react and request a seat. Guests appear on screen when a host approves them. Hosts run approved programs. What each role may do is enforced by the service, not by convention.
5. Host approval and fees
Hosting is by application and approval, at our discretion, against the published content standards. Approval is not guaranteed. Approved hosts pay a hosting fee. See the host agreement.
How fees are treated when a program is removed for cause is being finalised with counsel and will be stated here and in the host agreement before any fee is charged.
6. Acceptable use and content standards
The content standards, the community guidelines and the acceptable use policy form part of these terms.
7. Content ownership and licence
You own the content you broadcast. You grant Birby the licence necessary to transmit it, and to record and store it where recording is used.
8. Recording and restream
Shows may be recorded by their host. When a recording is running, an on-screen indicator is shown to everyone in the room for its duration. A host may also publish a recording as a replay, which is off by default and is the host's decision.
Flagged for counsel. Recording consent, including in two-party-consent jurisdictions, needs review. The on-screen indicator is what the software does; it is not a claim that it is sufficient.
9. Enforcement
We may remove, suspend or ban accounts and programs under the enforcement policy, which forms part of these terms. Decisions may be appealed once.

11. Payments
Hosting fees are processed by our payment processor. We do not store card details. Taxes are your responsibility where they apply.
12. Non-discrimination
Our standards are content-based. They apply to what is broadcast, equally to everyone. We do not exclude anyone from Birby on the basis of race, religion, nationality, sex, sexual orientation, gender identity, disability, or any other personal characteristic.
13. Disclaimers, liability, indemnity
Not drafted. Disclaimers, limitation of liability and indemnification are for counsel. Nothing plausible-looking has been written here on purpose: an invented liability cap reads as reviewed and is not.
14. Governing law and disputes
Not drafted. Governing law (undecided), dispute resolution and any arbitration terms are entirely counsel's call.
15. Changes and termination
We may update these terms. We may suspend or terminate accounts under the enforcement policy. You may stop using Birby at any time.
